Operator and acceptance

Atlas is a service operated by Watches by Los LLC under the Timekeeper Society brand. By using Atlas, an authorized user agrees to these terms and represents that they have authority to use Atlas for their organization.

Authorized use

Atlas is available to users who receive authorized access through an organization. Users must access only the account and organization they are permitted to use, protect their credentials and devices, and report suspected unauthorized access through the approved support process.

Organization access

Access is governed by organization membership, assigned roles, and capabilities. Organizations may manage or revoke access. Users may not bypass authorization controls, cross organization boundaries, or access records belonging to another organization.

Acceptable use

Users may not interfere with Atlas, probe or circumvent security controls, upload malicious or unlawful content, impersonate another person, or use the service in violation of law or organizational policy.

Customer content

Customers retain ownership of watch records, photographs, and other content they submit. Customers grant Watches by Los LLC a limited, non-exclusive license to host, store, process, display, transmit, back up, secure, maintain, and otherwise use that content only as reasonably necessary to operate Atlas. Customers are responsible for having the rights and authority needed to provide their content and for its accuracy.

Service availability

Atlas is provided on an as-available basis and may be unavailable during maintenance, provider interruptions, security events, or other operational conditions. Features may change as the service develops. Any service-level commitment must be established in a separate written agreement.

Suspension and termination

Access may be restricted or suspended to address security threats, unlawful activity, abuse or misuse, material violations of these terms, loss of organizational authorization, or actions necessary to protect Atlas or other users. After access ends, customer content is handled under the Privacy Policy and may be retained where reasonably necessary for service recovery, security, legal obligations, disputes, or enforcement.

Third-party services

Atlas depends on third-party authentication, hosting, image-management, and application-distribution services. Their availability and terms may affect Atlas.

Intellectual property

Atlas software, product presentation, and Timekeeper Society branding are protected by applicable intellectual-property laws. These terms do not transfer ownership of Atlas or customer content.

Warranties and liability

To the fullest extent permitted by law, Atlas is provided without warranties beyond those that cannot legally be excluded. Watches by Los LLC does not warrant uninterrupted or error-free operation.

To the fullest extent permitted by law, Watches by Los LLC will not be liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability arising from Atlas will not exceed the greater of $100 or the fees paid for Atlas during the twelve months preceding the event giving rise to the claim. These limitations do not restrict rights or remedies that cannot lawfully be waived.

Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes must be brought in an appropriate state or federal court located in New York, and the parties consent to those courts’ jurisdiction. These terms do not require arbitration or include a class-action waiver.

Changes

These terms may be updated when Atlas or applicable requirements change. The date above identifies the current version. Atlas will provide reasonable notice of material changes when appropriate.
